Russia has formed a hybrid between a dominant pre-capitalist fief-state system, with its authorities, non-market redistribution of resources, and new capitalist forms have appeared in the past 20 years. It resulted in the so-called new Russian capitalism peripheral type, preventing a full-fledged capitalist modernization in the form of a wide democracy, legal state, high-tech economy and civil society. That is all that distinguishes the country of the capitalist center from its periphery model.

Abstract. In article the questions concerning legal support of the relations of private-law character are considered, in the field of the housing relations which arise and are carried out between citizens of the Russian Federation and Republic of Belarus. In regulation of these relations there are legal problems in connection with that, in the housing legislation of these states there are essential distinctions. The comparative and legal analysis of the housing legislation of these states is carried out. It is noted that there is no due rapprochement (standardization) of the housing legislation of two states.

The effectiveness of the modern democracy is assessed through the effectiveness of the bodies of local self-government. The accession of the Russian Federation to the Council of Europe was connected with the ratification of the European Charter of local self-government and harmonizing with her Russian legislation. The basic principles of the Charter were reflected in the Constitution of the Russian Federation and Federal law. However, it remains poorly implemented the central idea of the reform is the approach of the authorities of the population, the real participation of citizens in local government.
